Assisted living facilities that provide customized living (CL) services to people on the Brain Injury (BI) and Community Access for Disability Inclusion (CADI) waivers must follow specific limitations based on the setting’s CL enrollment date. Before authorizing CL services, lead agencies must confirm the setting is eligible to support a person based on the applicable limitations.

This resource provides a comprehensive list of all current CL-enrolled settings and identifies the specific CL limitations that apply to each setting. Lead agencies should use this list as a tool in the CL authorization process for people on the BI and CADI waivers. Lead agencies must still verify the applicability of any CL setting limitations with the CL provider before authorizing services.

The DHS Disability Services Division (DSD) waiver policy and compliance team will maintain and update the list on a monthly basis through June 2025, then switch to a quarterly basis. If questions arise between publication dates, use the DSD Contact Form.

Note: This list is only accurate as of the “page updated” date. If a provider’s setting enrolled after the page updated date above, they should ask the lead agency to use the DSD Contact Form to confirm the setting is enrolled and services can be authorized.

The setting is licensed as a campus as defined in Minn. Stat. §144G.08.

Yes: The setting is licensed by MDH as a campus location, which means the provider operates multiple buildings at the same site. Only the main building's address is listed. To check if another address is part of the campus, use the DSD Contact Form.

No: The setting is not licensed by MDH as a campus. The provider operates only one building at the location

Bed capacity

This column includes the total number of beds allowed at the setting, per the setting’s assisted living license as approved by MDH.

Settings that deliver CL services in an affordable housing setting, as defined under Minn. Stat. §256S.20, subd. 1, are exempt from assisted living licensure and do not have a bed capacity listed.

Collocated

The setting is collocated, which means a single provider leases or owns more than one service setting located on the same or adjoining property.

Yes: The setting is collocated.

No: The setting is not collocated, it completed the 2017-2018 attestation process or it qualifies for the Jan. 1, 2023, exception.

Location limitation – institution

This limitation is applicable to all settings developed on or after May 1, 2001.

Yes: The setting must follow the identified limitation.

Location limitation – collocated

This limitation is applicable to all settings developed on or after May 1, 2001.

Yes: The setting must follow the identified limitation.

CL moratorium

This limitation is applicable to all settings developed on or after July 1, 2021, and licensed for four or fewer beds by MDH.

For the specific requirements of each limitation, refer to CBSM – CL (including 24-hour CL).

A setting must adhere to CL limitations based on its enrollment date. While some limitations may not affect the setting’s operations, the setting still must comply.

Example: ABC Home was enrolled to provide CL services on Jan. 1, 2018, which makes it subject to the location limitation. As a result, it cannot be located on the grounds of an institution. In the provider list, ABC Home would be marked with a "yes" in the "Location (institution)" column to indicate that it is subject to this limitation. It is important to note that the "yes" does not imply the setting is located on institutional grounds, but rather that the setting must follow the location restriction.
