SPECIAL SERVICES - APPLYING FOR SOCIAL SECURITY

Social Security Advocacy Services
The State contracts with agencies throughout the state to help children and adults apply for disability benefits through the Social Security Administration (SSA). Agencies can refer clients who need help to the Disability Hub MN at 1-866-333-2466 or the Social Security Advocacy Directory.

What can Social Security Advocacy Services help with?
They can help:

Conduct an initial screening to determine if the client meets SSA’s disability criteria

Complete an intake assessment

Act as an Authorized Representative with the Social Security Administration

Fill out forms and respond to notices

File initial applications and appeals

Represent at hearings

Represent at a continuing disability review

Who is eligible?
To qualify for Social Security Advocacy Services, clients must:

Have a disability that has lasted or is expected to last 12 months or longer;

Live in the State of Minnesota;

Be between birth and 65 years of age; and

Be homeless or at risk for homelessness, including those receiving public assistance benefits.



MFIP, GA, GRH:
Agencies are required to:

Identify clients who may be eligible for SSI or RSDI. See 0012.12 (Applying for Other Benefits).

Explain why a client must apply and what will happen if they do not apply for Social Security benefits within 90 days.

Ask questions to determine if there are barriers or valid reasons for not applying at this time. If good cause is granted, document in case notes and when the worker will follow up at a later time.

Provide Referrals: Refer clients who need additional help with the application of appeal process to State contracted Social Security Advocate or other service providers.

Verify Application Status: If the client does not provide verification by the due date, or the worker is unable to verify through an interface, issue a 10-day notice of adverse action to close the case. See 0026.15 (Notice of denial, termination, or suspension).

Obtain IAA for GA and GRH Only: Obtain the client’s signature on the SSI Interim Assistance Authorization (DHS-1795) and Interim Assistance Authorization (DHS-1795A).

Update the PBEN panel within 30 days of receiving the form(s). See
0012.12.02 (Interim Assistance Authorization for RSDI and OMB) and 12.12.03 (Interim Assistance Authorization for SSI).

Track the status of the client’s SSI and RSDI application and update the outcome/disposition. See TE02.05.116 (PBEN Entry).

Respond to Inquiries: Provide priority response to SSA and DHS regarding the client’s SSI/RSDI claim.

Update MAXIS Panels Upon Approval: If the client is approved for SSI or RSDI update the appropriate Maxis panels and make other benefit adjustments as appropriate. See 0008 (Changes in Circumstances). Covert the client to MSA. See TE02.10.55 (GA case - client gains SSI elig Part 1) and TE02.10.56 (GA case - client gains SSI elig Part 2).

Screen clients who have received GA for 24 months of more for potential SSI and RSDI eligibility. Refer the client to apply for SSI and RSDI if appropriate. If good cause is granted, document in case notes and when the worker will follow up at a later time.



DWP, SNAP:
No provisions.


MSA:
Social Security Advocacy Services are available to clients who need help completing a continuing disability review. Agencies should refer clients to SSA or a Social Security Advocate if they believe SSI should not have been terminated.
