LAWFULLY RESIDING PEOPLE

People who are lawfully residing are non-citizens who have legal permission to be in the United States but who do not have a permanent immigration status.

These are people who:

Are applicants for a more permanent immigration status and waiting for an answer, or

Have a special permission to be in the United States because of the age they were when they entered the United States, or

Cannot return to their home country because it is not safe, or

Entered the country for public interest or humanitarian reasons.

People who are lawfully residing usually have a short-term permission to live and work in the United States that they have to renew to remain eligible for public benefits. People who are lawfully residing are generally only eligible for state-funded benefits as long as they meet all other eligibility factors. 0031.03.01 (Asylum Applicants) with USCIS

0031.03.03 (Deferred Action)

0031.03.06 (Deferred Action for Childhood Arrivals (DACA))

0031.03.09 (Deferred Enforced Departure (DED))

0031.03.12 (Applicants for Lawful Permanent Residence Status)

0031.03.15 (Paroled into the United States for less than one Year)

- This does NOT include Afghan Humanitarian Parolees, Cuban Entrants, Haitian Entrants, or Ukrainian Humanitarian Parolees.

0031.03.18 (Special Immigrant Juvenile Status)

0031.03.21 (Temporary Protected Status (TPS))
