Nursing Facility Enrollment Criteria and Forms

To enroll as a nursing facility (NF) with Minnesota Health Care Programs (MHCP) or to complete revalidation, the NF must be certified and licensed by the Minnesota Department of Health (MDH) or the health department in the state in which it is located. Nursing facilities are considered a low risk provider.

Conditions of Enrollment

Requirements for Termination of Provider Agreement
A nursing facility that chooses not to comply with the Equalization Law may voluntarily withdraw from enrollment in MHCP. Also, the Minnesota Department of Human Services (DHS), MDH or the Centers for Medicare & Medicaid Services (CMS) may recommend that a nursing facility’s enrollment with MHCP be terminated for not complying with the Equalization Law.

Under most of these circumstances, the provider becomes ineligible to receive payment under other state and county programs. Special laws apply to nursing facility providers that withdraw from MHCP (contact the Long-Term Care Policy Center at DHS.LTCpolicycenter@state.mn.us for more information). If discharge of members is necessary, discharge planning and relocation must be done according to all provisions of state and federal resident rights and the state Resident Relocation Law.

Nursing Facilities that Segregate Members Not Eligible to Enroll
Partial certification or de-certification of a distinct part of a nursing facility may result in the segregation of MHCP members. These practices discriminate against members based on their source of funding and may violate both the Equalization Law and anti-discrimination laws. DHS will not enroll facilities that stigmatize residents receiving public assistance or practice other forms of resident discrimination. DHS will investigate nursing facilities that intend to or have segregated members.

Solicitation of Contributions Prohibited
Federal law prohibits soliciting contributions, donations or gifts directly from MHCP members or family members. General public appeals for contributions are not considered direct solicitation of members or families. If an MHCP member or family member makes a free-will contribution, the long-term care (LTC) provider is required to execute a statement for signature by the contributor and the LTC administrator, stating services provided in the nursing facility are not predicated upon contributions or donations and the gifts are free-will contributions.

How to Enroll

Nursing facilities who wish to enroll with MHCP or make enrollment requests can do so in one of the following two ways.

  • · Register to access the Minnesota Provider Screening and Enrollment (MPSE) portal and complete your enrollment online using the MPSE portal. Also, upload the following in the MPSE portal:
  • · Copy of current Minnesota state nursing license issued by the Minnesota Department of Health
  • · Provider Agreement (DHS-4138) (PDF)
  • or

  • · Complete the following documents required to enroll as an NF and fax your materials to MHCP at 651-431-7462.

  • · Disclosure of Ownership and Control Interest (DHS-5259) (PDF) (All owners, board members and managing employees must be disclosed)
  • · Copy of current Minnesota state nursing license issued by the Minnesota Department of Health
  • A hospital may also apply to be a swing bed provider. To be eligible to provide this service, the provider must be Medicare certified and must sign a Swing Bed Provider Agreement with DHS.     We process forms in order of date received. Whether enrolling using the MPSE portal or by fax, allow 30 days for processing. If we need more information to complete your enrollment, we will send a notice telling you what we need or what you need to do to complete your enrollment.

    Revalidation

    MHCP is required to follow CMS final federal provider screening regulations.

    Reporting Changes

    Report any changes made on a record to MHCP. Refer to Changes to Enrollment in the Enroll with MHCP section of the MHCP Provider Manual for details.
