EW amendment approved by CMS

CMS approved DHS’ waiver amendment package on Dec. 31, 2024, for the Elderly Waiver (EW).

CMS also approved waiver amendment packages for the following disability waivers:

· Brain Injury (BI).

· Community Alternative Care (CAC).

· Community Access for Disability Inclusion (CADI).

· Developmental Disabilities (DD).

Implementation of changes and clarifications

DHS has not implemented the changes and clarifications in this eList yet. First, we must update our policy manuals and affected systems as applicable. DHS will send eList announcements and/or update CBSM – What’s new when we implement the changes and clarifications.

Summary of changes and clarifications

The following sections summarize the policy changes and clarifications included in this waiver amendment package.

Technical changes include:

· Replaced references to “lead agency” with “county or tribal human services organization” where appropriate.

· Incorporated previously approved provisions related to extended Community First Services and Supports (CFSS).

MnCHOICES: Waiver eligibility, assessment and support planning	· Updated certified assessor qualifications to align with state law
Adult foster care	· Added an allowance for adult foster care to be provided in certain settings with a capacity of up to six people
Respite	· Updated maximum number of people served in an unlicensed setting
