Purpose: To announce a tool for lead agencies authorizing CL services for people on the Brain Injury (BI) and Community Access for Disability Inclusion (CADI) waivers

Publication of CL setting list

DHS published a list of all home and community-based services (HCBS) settings actively licensed by the Minnesota Department of Health (MDH) as an assisted living facility and enrolled with DHS to deliver CL services.

CBSM – Assisted living facilities licensed by MDH and enrolled to deliver CL by DHS is a resource for authorizing CL services through the BI and CADI waivers. It includes the following information:

1. Provider name.

2. Setting address.

3. If the setting is licensed by MDH as a campus.

4. MDH-approved licensed bed capacity.

5. If the setting is collocated.

6. If the setting is subject to the following CL limitations:

  • · Institution: Applicable to all settings developed on or after May 1, 2001.
  • · Collocation: Applicable to all settings developed on or after May 1, 2001.
  • · Size: Applicable to all settings developed between May 1, 2001, and Jan. 10, 2021.
  • · Age: Applicable to all setting developed on or after Jan. 11, 2021.
  • · CL moratorium: Applicable to all settings developed on or after July 1, 2021, and licensed for four or fewer beds by MDH.
  • For the specific requirements of each limitation, refer to CBSM – CL (including 24-hour CL).

    Purpose

    Before authorizing CL services, lead agencies must confirm the setting is eligible to support a person based on the applicable limitations. Lead agencies can use CBSM – Assisted living facilities licensed by MDH and enrolled to deliver CL by DHS as a resource in this process.

    Note: This list is only accurate as of the “page updated” date on the page. If a provider’s setting enrolled after the “page updated” date, they should ask the lead agency to use the DSD Contact Form to confirm the setting is enrolled and services can be authorized.

    Next steps

    The DSD waiver policy and compliance team will maintain and update the list on a monthly basis through June 2025, then switch to a quarterly basis. If questions arise between publication dates, use the DSD Contact Form.
