New EIDBI clinical supervision requirements

The 2025 Legislature passed EIDBI clinical supervision requirements in Minn. Stat. §256B.0949, subd. 16. These requirements ensure consistent oversight and support of direct intervention services.

Minimum supervision ratio requirement

Effective Jan. 1, 2026, the qualified supervising professional (QSP) must provide at least one hour of clinical supervision for every 16 hours of direct treatment, unless otherwise specified in the person’s EIDBI ITP and Progress Monitoring Form, DHS-7109.

Observation and direction requirements

Effective Jan. 1, 2026, the EIDBI agency (i.e., QSP, level I or level II provider):

  • · Must provide observation and direction at least once per month for each person receiving services.
  • · Cannot provide more than two consecutive months of observation and direction via telehealth for each person receiving services.
  • DHS recommends that the QSP provides observation and direction, particularly for people who have higher needs and new staff.

    Policy manual updates

    DHS updated EIDBI Manual – Clinical supervision to reflect these new requirements and clarify recommendations.

    ITP updates

    DHS updated section C of EIDBI ITP and Progress Monitoring Form, DHS-7109 to reflect the new minimum supervision ratio requirement. The new “EIDBI clinical supervision frequency” section includes:

  • · A checkbox to confirm the QSP will meet the standard 1:16 supervision ratio.
  • · An option to request an alternate supervision plan if one is clinically necessary.
  • This change helps ensure transparency and alignment with EIDBI policy. It also supports quality assurance and treatment fidelity by clearly outlining the supervision plan for each person who receives services.

    Provider instructions

    EIDBI agencies must:

  • · Review EIDBI Manual – Clinical supervision for information about these new requirements.
  • · Use the updated EIDBI ITP and Progress Monitoring Form, DHS-7109 and complete the new clinical supervision frequency section for any treatment plans with service authorization dates in 2026.
  • · Review EIDBI Manual – How to complete ITP and Progress Monitoring, DHS-7109 for additional instructions.
