Upcoming changes to IHS

The Minnesota Legislature passed changes affecting IHS services in Laws 2026, chapter 121, including amendments to Minn. Stat. §256B.4914, subd. 8. DHS announced some of these changes in a March 31, 2026, eList announcement.

We are sharing this eList announcement to help lead agencies prepare for the upcoming changes.

Note: These changes are not effective yet. Lead agencies should not use these changes for service authorization decisions until we announce implementation instructions.

Lead agency actions

Until DHS announces implementation instructions, lead agencies must:

  • · Continue to follow current policy and service authorization requirements on CBSM – IHS, including service limits and covered and non-covered services.
  • · Not implement the 2025 and 2026 legislative changes described below.
  • Summary of upcoming legislative changes

    The upcoming legislative changes affect:

  • · IHS with training.
  • · IHS with family training.
  • · Multiple IHS services delivered by one provider.
  • IHS with training

    The 2026 legislature authorized the following changes to IHS with training:

  • · Establish a monthly service limit of 182.5 hours for IHS with training.
  • · Remove the requirement that IHS with training and IHS with family training must be limited to a maximum of three consecutive hours per day.
  • Note: These changes do not limit a person’s use of other disability waiver services, including IHS without training.

    DHS next steps

    Before DHS can implement this change, we must:

  • · Receive federal approval.
  • · Complete system updates.
  • IHS with family training

    The 2025 legislature limited IHS with family training to six hours per day.

    DHS next steps

    DHS received federal approval for this change in March 2026. Before we can implement this change, we must complete system updates.

    Multiple IHS services delivered by one provider

    The 2025 legislature clarified that a person may receive IHS with training or IHS with family training on the same day as IHS without training from the same provider.

  • · Update CBSM – Resource: Service options for IHS to add guidance to help lead agencies determine which IHS service option is most appropriate based on the person’s assessed needs.
