CRIMINAL CONVICTION

People convicted of a criminal offense or fleeing prosecution may be ineligible for certain programs for a period of time or subject to certain requirements. See the sections listed below for information on the individual offenses:
● | Drug felony. See 0011.27.03 (Drug Felons). |
● | Parole violation. See 0011.27.06 (Parole Violators). |
● | Fleeing prosecution. See 0011.27.09 (Fleeing Felons). |
● | Residency fraud conviction. See 0011.27.12 (Residency Fraud Conviction). |
These penalties are not fraud disqualifications based on Intentional Program Violation (IPV). For information on fraud disqualifications, see 0025.24.06 (Disqualification for Fraud).

Follow general provisions.
SNAP:
A person is not eligible for SNAP benefits if the person is convicted as an adult and is not in compliance with the terms of the sentence for the offenses listed below. Non-compliance with the offense terms of the conviction needs to be verified before the person is not eligible for SNAP.
1. | A Federal offense involving aggravated sexual abuse. |
2. | A Federal offense involving murder. |
3. | A Federal offense involving sexual exploitation and other abuse of children. |
4. | A Federal or State offense involving sexual assault. |
OR | |
5. | An offense under State law determined by the Attorney General to be substantially similar to an offense 1, 2 and 3 described above. |
This disqualification does not apply to a conviction for an offense occurring on or before February 7, 2014.
Because the specific offenses in this section are identified in Federal regulations and DHS may need to confer with the Attorney’s General office for offenses under State law, staff should submit a request to PolicyQuest to confirm that the offense is included before imposing the disqualification.
