8.15 Termination

Terminate child care assistance when:
· The family asks you to close their case.· A member of the family has been disqualified for committing an Intentional Program Violation (IPV). See Chapter 13.6 (Disqualification for wrongfully obtaining assistance – Families).· The family is no longer eligible. There are different eligibility requirements at redetermination than during a family’s 12-month eligibility period.Send a notice of termination to the family at least 15 calendar days before closing the case. See Chapter 12.3.12 (Termination notices - Family).
Reasons a family is no longer eligible during the 12-month eligibility period
There are limited reasons families lose eligibility during the 12-month eligibility period. Do not apply redetermination eligibility requirements during the 12-month eligibility period.
During the 12-month eligibility period, you must terminate a family’s eligibility when:
· Income exceeds 85% of State Median Income (SMI).· Assets exceed $1 million.· Extended Eligibility period ends and there is no authorized activity.· All available job search hours outside of an Employment Plan have been used and there is no authorized activity.· Copayment has not been paid.· The family moves out of state.· There are no eligible children in the household.· The only parent in the household has been temporarily absent for more than 60 days AND the parent is not in an authorized activity OR their Extended Eligibility period has ended. See Chapter 5.6 (CCAP family – Temporary absence).· The family’s MFIP eligibility ends, they are not eligible for TY and there is not funding for BSF.· The family’s one year suspension period has expired.· The family’s temporary ineligibility period has expired and eligibility has not been re-established.· It is discovered and verified during the 12-month eligibility period that the family did not meet eligibility requirements at application or redetermination. NOTE: Due to 12-month eligibility policy, MEC² will not generate ineligible results. Contact your CCAP policy specialist for assistance in generating correct eligibility results.Terminating eligibility around the redetermination due date
If any of these termination reasons occur when the redetermination biweekly period is available in the approval package, ineligible results are not available to be approved. Workers must follow the following workaround:
· Close the family’s Service Authorization with a 15-day adverse action notice using the closing reason “Care is no longer authorized.”· Send the family the Child Care Assistance Notice of Decision – Termination (DHS-5588A) (PDF) to terminate eligibility with a 15-day adverse action notice (align with the Service Authorization end date). Include the reason that eligibility is ending. · NOTE: The system will still show the family’s case as open and will automatically generate a termination notice as part of the auto-batch closing for their redetermination. To prevent confusion, add the following language to the manual termination notice: · “Your case is closing [DATE] because [REASON]. If this issue is resolved, your case will close [REDETERMINATION DUE DATE] if your redetermination is not complete. You may receive a notice that your eligibility is ending due to no redetermination even if you haven’t resolved this case closure. If you haven’t addressed [REASON], your correct case closing date is indicated on this notice and you can disregard the second notice.” · A copy of the termination notice should be copied into the case file. · Case note all actions. At redetermination, families must meet eligibility requirements in Chapter 4 (Eligibility requirements) and Chapter 6 (Income eligibility).
At redetermination, terminate a family’s eligibility when:
· Income exceeds 67% of State Median Income (SMI).· Assets exceed $1 million.· The family is not in an eligible activity that meets any applicable minimum participation requirements.· The family is not cooperating with child support.· Completed redetermination is not received by the last day of the redetermination period, which could include:· Redetermination form is not received.· Verifications required to establish eligibility at redetermination are not received. · Verifications requested for factors required to be verified during the previous 12-month eligibility period are not received; see Chapter 7.4 (Verification - 12-Month Eligibility Period).· Verifications requested due to inconsistent information during the previous 12-month eligibility period are not received; see Chapter 7.4.3 (Inconsistent Information).· The family’s one year suspension period has expired.The family’s only child eligible for CCAP is age 13 or their only child eligible for CCAP is age 15 with a documented disability.
