WHO IS EXEMPT FROM THE SNAP TIME-LIMITED WORK RULES

SNAP:
There are 2 sets of work rules for SNAP; general work rules and time-limited work rules. To determine who must follow these work rules see 0028.07 (General Work Rules for SNAP) and 0011.24 (Time-limited SNAP Recipients).

When determining what work rules a SNAP recipient must follow, the first step is to determine if they are exempt from the general work rules (AKA “Work Registration”). See 0028.06.12 (Who is Exempt from the SNAP General Work Rules) for the list of exemptions from the general work rules. When someone is exempt from general work rules, they do not have to follow any work rules to receive SNAP benefits and are not a Time-limited Recipient (TLR). Note: Participants aged 60-64 are exempt from the general work rules but are a TLR subject to the time-limited work rules unless they meet another exemption.

When a SNAP recipient does not meet an exemption from the general work rules as listed in 0028.06.12 (Who is Exempt from the SNAP General Work Rules) the next step is to evaluate if they are exempt from the time-limited work rules. The SNAP Work Rules Screening Questions (DHS-8456) is not a mandatory form but is a helpful resource to screen for exemptions from the general work rules and time-limited work rules.

The following people are subject to the general work rules but are exempt from time-limited work rules:

Age 16-17 and not living with a parent or caregiver. When the recipient turns 18 during the certification period, review if they meet another exemption. If they do not, continue this exemption until the end of their certification period.

Has a mandatory SNAP unit member under the age of 14 residing in their home, even when the child is not eligible for SNAP. The exemption can be given to each adult in the SNAP unit regardless of the number of children under 14 and the person’s relationship to the child. Uncle Harry Food Support units residing in a home with a unit member under the age of 14 meet this exemption even when the person under the age of 14 is in an MFIP or RCA unit. Pregnant.

A participant of Refugee Cash Assistance (RCA) who is working with a Refugee Employment Services Provider. If there is no Refugee Employment Services provider available, you may refer them to a SNAP E&T provider. See 0030.12 (Refugee Employment Services).

Is a participant who meets any of the criteria below:

  1. An American Indian/Alaskan Native (regardless of whether they live on or near a reservation), who is a member of a tribe, band, or other organized group of Indians, including those tribes, bands, or groups terminated since 1940 and those recognized now or in the future by the State in which they reside, or who is a descendant, in the first or second degree, of any such member.
  2. Is a California Indian. The term “California Indian” includes:
  3. Any descendant of an Indian who was residing in California on June 1, 1852, if such descendant is a member of the Indian community served by a local program of the Service; and is regarded as an Indian by the community in which such descendant lives.
  4. Any Indian who holds trust interests in public domain, national forest, or reservation allotments in California.
  5. Any Indian of California who is listed on the plans for distribution of the assets of rancherias and reservations located within the State of California under the Act of August 18, 1958 (72 Stat. 619), and any descendant of such an Indian.
  6. Is an Urban Indian. The term “Urban Indian” means any individual who resides in an urban community, with unmet health needs and meets one of the criteria in the A above.

Recipients meeting an exemption for part of a month are considered exempt for the entire month.

When a SNAP recipient meets an exemption listed above, they are exempt from following the time-limited work rules to receive SNAP benefits and are not a Time-limited Recipient (TLR). They do, however, must follow the general work rules. See 0028.07 (General Work Rules for SNAP) for more information on what the general work rules are.

All of the general work rules must be verbally explained to the SNAP unit at:

  • Application
  • Recertification
  • When a person moves into the unit and is subject to the general work rules
  • When a recipient has a change to the general work rules they must follow.

You must also give or send Supplemental Nutrition Assistance Program (SNAP) Work Rules Notice (DHS-8159) (PDF) and verbally explain the general work rules they must follow. This conversation can be held with any SNAP unit member age 18 or older or authorized representative. You do not have to explain the time-limited work rules to anyone that meets an exemption above but do have to explain the general work rules since they are not exempt from these rules. Document reviewing this information in MAXIS case notes and save a copy of the completed DHS-8159 in the case file.

Verification
Accept a client’s verbal statement to exempt them from the time-limited work rules, unless questionable.

Redetermination of an Exemption
Rescreen all SNAP unit members aged 16 and older for all exemptions at recertification. For changes to the client’s exemption status during the certification period, see 0008.06.01 (Implementing Changes – Program Provisions).

Documentation
Documentation in case notes is required when exempting an individual from the time-limited rules. Note when an exemption is applied based on your own conversation with the unit and/or when verifications are requested and the reason for requesting them.
