Notice and Order of Hearing on Petition for Formal Probate of Will, Determination of Heirship, Appointment of Personal Representative, and Notice to Creditors (DHS-8349A)

Follow the instructions for (DHS-8349A) (PDF) to give notice that there will be a hearing for probate with a will.

1. Fill in the header.

· Enter your county name in the top left.

· Enter the deceased person’s name on the left.

· Enter the court district number in the top right. If you are unsure of your district, look up the court district.

· Since you are opening a new court file, you do not need to enter a file number.

2. Fill in the body.

· Enter the date, time, and place of the hearing the court has scheduled for this matter. If you don’t have one, you can submit the form without one and the court will enter the information before the judge signs it.

· Enter the date the will was executed.

· Enter your name and office address in the next two blanks.

3. Submit this document to the court without dating or signing. The judge will sign the document once the court approves it.
