3.6.15 - CLIENT RIGHTS - APPEALS

The MAXIS system issues all notices of adverse action. A Supplemental Nutrition Assistance Program (SNAP) applicant or recipient may appeal any notice of adverse action within 30 days from the date of being notified of the action. If the person can show good cause for not appealing within 30 days, the appeal can be accepted for up to 90 days from the notice of adverse action.
Refer all appeal requests to the State Appeals Office. Do this regardless of when you receive the request, and regardless of the client's reason for making a late appeal request. The Appeals Office will convene a hearing and decide the issue of timeliness or good cause at that time.
The appeal may be made to the county agency or directly to the State Appeals Office at the Department of Human Services. For written appeals, clients may use the Appeal to State Agency form (DHS-0033) (PDF) or may send a letter indicating disagreement with the county agency's decision to:

People may request an appeal hearing orally or in writing. They must state what county agency action they are appealing.
The recipient may request that SNAP benefits continue pending appeal. However, if the recipient loses the appeal, the SNAP benefits issued during appeal process will need to be returned/repaid.
Most SNAP appeals are decided within 60 days of the date of the request for a hearing.
