State and lead agency oversight responsibilities

Background  

The Centers for Medicare & Medicaid Services (CMS) hold each state responsible for the health and safety of people who receive services. CMS requirements for health and safety assurance include the following:

  • · Ensure behavioral safeguards for use of restraints and restrictive intervention are in place and adhered to.
  • · Ensure medication administration and management procedures are in place and adhered to.
  • · Report critical events or incidents.
  • · Train and educate concerning abuse, neglect and exploitation.
  • · The system Minnesota uses to monitor services that ensure the health and welfare of people who receive services relies upon implementation of state-developed standards.
  • · In a lead agency-based system, such as Minnesota’s, the state shares that responsibility with each lead agency.
  • State responsibilities

    The state is responsible to:

  • · Design model procedures and protocols.
  • · Develop, acquire and distribute materials for training toolkits.
  • · Redesign systems.
  • · Train people who receive services, lead agency workers and external and internal stakeholders.
  • · Establish qualifications and service performance standards for providers.
  • · Review, approve and assure compliance of providers as eligible to deliver services to people who participate in programs.
  • · Provide enrollment and compliance assistance to service providers.
  • · Coordinate with counties/tribal nations in responding to provider quality issues and noncompliance.
  • DHS and social services lead agencies maintain an active investigative force to resolve and report incidents that relate to maltreatment of vulnerable persons. Refer to CBSM – Adult protection.

    Lead agency responsibilities

    Lead agencies are responsible to plan, provide, arrange and monitor services for eligible people to ensure consistent delivery of supports and services. Case managers/service coordinators:

  • · Encourage people who receive services and families to make informed choices to meet their individual needs.
  • · Oversee the well-being of a person.
  • · Systematically monitor provider performance.
  • · Determine where provider issues, detected in the course of case management monitoring and oversight, warrant reporting to the state.
  • · Exercise the option to enroll with DHS on behalf of market and receipt service.
  • · Are providers (as determined by DHS) in accordance with state policy.
  • Provider enrollment

    To participate as a Minnesota Health Care Programs (MHCP) provider, providers must meet professional, certification and/or licensure requirements in state and federal laws and regulations. Refer to MHCP Provider Enrollment.

    State resources

    As a part of its oversight responsibilities, DHS continually develops information and resources to assist lead agencies. If you are unable to find information in the CBSM, the following resources are available to lead agencies:

    Regional Resource Specialists

    DHS employs Regional Resource Specialists (RRS) to work with lead agencies and provide technical assistance at both the system level and individual level. Refer to CBSM – RRSs or the RRS Geographic Area Map , DHS-4850B (PDF).

    Policy response

    PolicyQuest is an automated web-based system. Lead agencies may submit policy questions through PolicyQuest if they are not able to find the policy information in the CBSM or other sources.

    Service Agreement and Screening Document (SASD) Support Team

    The SASD Support Team is a help desk that provides technical assistance to lead agencies and DHS staff for the Medicaid Management Information System (MMIS) related specifically to service agreements and screening documents.
