4.9.12 Child Support Cooperation at Redetermination

Child Support cooperation is a CCAP eligibility factor that must be verified at redetermination.

Determining cooperation status for children in foster care

Consider a family with a foster child to be cooperating at redetermination when the foster parent(s) complete and sign the redetermination form. See Chapter 4.9 (Cooperation with Child Support). The completed redetermination meets the child support cooperation requirements for their foster children.

Determining cooperation status for all other minor children with an absent parent

45 days prior to redetermination due date

Workers receive an MEC² Alert when a family’s redetermination is sent 45 days prior to the redetermination due date. Upon receiving the alert, check PRISM or with the Child Support worker to determine whether the family is cooperating with Child Support for each minor child in the CCAP family with an absent parent. If the family is not cooperating, checking the family’s cooperation status when the redetermination is sent allows the family time to meet Child Support requirements by the redetermination due date. Send the family a Memo to notify them that they must cooperate by the redetermination due date or their CCAP case will close. Include their Child Support worker’s name and phone number, if known. The Child Support case status and cooperation code are located on the GCSC window in PRISM.

Redetermination processing

When processing the redetermination, check PRISM or with the Child Support worker to see if the family is cooperating with Child Support enforcement for each minor child with an absent parent. The Child Support case status and cooperation code are located on the GCSC window in PRISM. See the MEC2 User Manual for “Child Support Cooperation and Good Cause Safety Concern (GCSC)” guidance.

  • · If PRISM or the local Child Support agency indicate that there is an open Child Support case for each child with an absent parent in a cooperating status, the redetermination can be processed.
  • · If PRISM or the local Child Support agency determine that there is an open Child Support case for each child with an absent parent but the family is not cooperating, include this in the special letter or memo requesting that the family must cooperate by the redetermination due date, or their CCAP case will close. Include their Child Support worker’s name and phone number, if known.
  • · If there is no open Child Support case or the local Child Support agency determines that a closed case in PRISM requires new forms or the family had a change in family composition during the 12-month eligibility period that required Child Support cooperation:
  • · Send the Cooperation with Child Support Enforcement (DHS-2338) (PDF), Understanding Child Support-A handbook for Parents (DHS-3393) (PDF) and Referral to Support and Collections (DHS-3163B) (PDF) forms to the family.
  • · Notify the family that the Referral to Support and Collections (DHS-3163B) form must be completed and returned by the redetermination due date, or their CCAP case will close.
  • · If the family is not cooperating with Child Support by the redetermination due date, allow the case to close for failure to complete redetermination.
  • Redetermination processing - Reinstatement

    If the family submits a completed redetermination form and all required eligibility verifications within 30 calendar days after their case closes, the case can be reinstated back to the date the case closed if all other redetermination eligibility factors are met. Prior to reinstating, check PRISM or with the Child Support worker to see if the family is cooperating with Child Support for each minor child with an absent parent. The Child Support case status and cooperation code are located on the GCSC window in PRISM.

  • · If the family is cooperating with Child Support and all other requirements are met, the case can be reinstated back to the date it closed.
  • · If the family is not cooperating with Child Support, the case cannot be reinstated. Inform the family that cooperation is needed by the end of the 30-day reinstatement period.
  • · If cooperation is met after the 30-day reinstatement period, the family will need to reapply for CCAP and cooperate with Child Support at application.
