Allowable and unallowable goods and services under CDCS

Legal authority

Federally approved Brain Injury (BI), Community Alternative Care (CAC), Community Access for Disability Inclusion (CADI), Developmental Disabilities (DD) and Elderly Waiver (EW) waiver plans, federally approved Alternative Care (AC) 1115 demonstration, Minn. Stat. §256B.0913

Definitions

Allowable expenditure: A good or service that is covered under CDCS and can be purchased using waiver/AC funds.

Unallowable expenditure: A good or service that is not covered under CDCS and cannot be purchased using waiver/AC funds.

Direct benefit: Good or service purchased to meet the person’s assessed needs. This includes services that provide relief or training for caregivers if the person chooses and benefits from that support (e.g., respite, homemaker, chore services, family training and counseling, specialist services, family caregiver services).

Allowable expenditures

CDCS goods and services must:

  • · Be listed in the person’s CDCS community support plan.
  • · Be necessary to meet a need identified in the person’s assessment.
  • · Be related to the person’s disability (all programs) and/or condition (AC/EW only).
  • · Be for the direct benefit of the person.
  • · Meet the criteria for one of the CDCS service categories. For more information, refer to CDCS Manual – Unbundled CDCS service categories.
  • Note: All service categories have additional criteria specific to that category. For more information, refer to the manual page for each category.

    Unallowable expenditures

    CDCS does not cover:

    1. Goods and services that are:

  • · Provided before the person’s CDCS community support plan is approved.
  • · Not included in the approved CDCS community support plan.
  • · Recreational or diversionary in nature.
  • · For comfort or convenience.
  • · Duplicative of other services in the CDCS community support plan.
  • · A substitute for informal supports that appropriately meet the person’s needs.
  • · Not the most cost-effective means to meet the person’s needs.
  • · Available through other funding sources (refer to the section below).
  • 2. Educational expenses.

    3. Utilities.

    4. Travel, lodging or meal expenses.

    5. Items or support normally provided by the person or their parents, family or spouse.

    6. Prescription medications, over-the-counter medications, compounds (as defined in Minn. R. 6800.3100), solutions and related costs (including insurance premiums and co-pays).

    7. Animals (including service animals) and their related costs.

    8. Attorney costs or costs related to advocate agencies.

    9. Fees incurred by the person (e.g., Minnesota Health Care Program [MHCP] fees and co-pays).

    10. General vehicle maintenance.

    11. Membership dues or costs, except health club memberships for adults.

    12. Insurance costs other than for directly hired workers.

    13. Room and board.

    14. Personal items.

    15. Tickets and related costs to attend sporting or other recreational events.

    16. Vacation expenses.

    17. Internet access for unbundled CDCS community support plans.

    Note: All service categories have additional criteria specific to that category. For more information, refer to the manual page for each category.

    Other funding sources

    Waivers/AC cannot be used for goods or services covered by other funding sources, including:

  • · Medical Assistance (MA).
  • · Medicare.
  • · Educational expenses.
  • · Title IV-E of the Social Security Act.
  • · Vocational services available and funded under Section 110 of the Rehabilitation Act of 1973 (refer to CBSM – Guidance for employment services authorization).
  • · Long-term care insurance.
  • · Other liable third parties.
