DWP non-compliance overview

Agencies disqualify Diversionary Work Program (DWP) participants from DWP when they do not comply with employment services or child support enforcement requirements.

Whether the family is or continues to be eligible for child care assistance depends on the type of non-compliance and participation in authorized activities.

CCAP actions when a DWP case closes for non-compliance

When a family on DWP is not in compliance with employment services or not cooperating with child support enforcement, their DWP case closes. If a family’s DWP case closes, assess the family’s eligibility for Transition Year (TY). The family is eligible for TY if the family received DWP cash assistance for at least one of the last six months prior to the closing of their DWP cash assistance. If employed, the family does not need to meet minimum activity requirements until redetermination.

Non-compliance with employment services

During the 12-month eligibility period, eligibility continues for employed families even if they work less than the applicable minimum activity requirements.

If a family was authorized for child care under an Employment Plan and it is unknown if the family is participating in any or all of the activities when DWP closes, move the family to Extended Eligibility. See Chapter 9.15.6 (Extended Eligibility).

Non-cooperation with child support

During the 12-month eligibility period, eligibility continues for families in non-cooperation with child support until their redetermination. The family must cooperate with child support at redetermination to continue receiving child care assistance. See Chapter 4.9.12 (Child Support cooperation at redetermination).
