HSP BASIS - DISABLED AGE 18 AND OLDER

HSP:
People have a basis of eligibility for HSP if they are disabled, age 18 or older, AND are SSI recipients or would be eligible for SSI benefits EXCEPT for excess income. Disabled means the inability to work and support oneself because of a permanent and total physical or mental impairment.
Non-SSI participants (due to excess income) who are age 65 or older, and disabled or blind, may choose their HSP basis of eligibility. The basis may affect the disregards allowed from actual earned income. Help the client decide which eligibility basis is most advantageous. Consider people disabled if:
● | They receive or have been awarded RSDI or SSI based on their disability. |
OR | |
● | They are ineligible for SSI because of income and are certified as disabled by the State Medical Review Team (SMRT). See 0012.15 (Incapacity and Disability Determinations), 0012.15.06 (State Medical Review Team (SMRT)). |
