PCA/CFSS provider agency requirements overview

Comparison of PCA and CFSS

DHS is in the process of replacing PCA with CFSS. For more information about this transition, refer to CFSS Manual – Transition from PCA and CSG to CFSS.

Similarities

In both PCA and CFSS, the provider agency must:

  • · Have a manual that describes their policies and procedures.
  • · Give people information about their rights.
  • · Comply with provider marketing policies.
  • · Ensure staff members meet training requirements.
  • · Evaluate and supervise services.
  • · Comply with legal requirements for workers’ wages.
  • · Ensure they are never the provider agency and the housing provider for the same person.
  • · Meet all requirements for Minnesota Health Care Programs (MHCP) providers.
  • Differences

    In CFSS, there are two provider types that are not in PCA. For more information about those provider requirements, refer to:

  • Policies and procedures manual

    PCA/CFSS provider agencies must have a manual that describes their policies and procedures. For more information, refer to CFSS Manual – PCA/CFSS provider agency policies and procedures.

    Person’s rights

    PCA/CFSS provider agencies must:

  • · Give people information about their rights (refer to CFSS Manual – Person’s rights and responsibilities in PCA/CFSS).
  • · Notify the person in advance if they plan to discontinue being their provider (refer to CFSS Manual – Changing PCA/CFSS provider agencies).
  • Provider marketing policies

    PCA/CFSS provider agencies:

  • · Cannot market to people directly based on their perceived disability or public assistance status.
  • · Must document all marketing costs.

    Staff training requirements

    PCA/CFSS provider agencies must ensure staff complete required training.

    Evaluation and supervision of services and workers

    Services

    PCA/CFSS provider agencies must evaluate and supervise services.

    In PCA, this evaluation and supervision is done by the qualified professional (QP). For more information, refer to PCA Manual – QP requirements overview.

    In CFSS, the provider agency has more flexibility in who evaluates and supervises services. For information on the evaluation and supervision of CFSS services, refer to CFSS Manual – CFSS provider agency evaluation of services.

    Workers

    PCA and CFSS provider agencies are responsible to supervise support workers.

    Legal requirements for workers’ wages

    PCA and CFSS provider agencies must:

  • · Pay wages and benefits equal to or greater than the sum total of 72.5% of the revenue from the rate for PCA/CFSS services.
  • · Pass on the 7.5% enhanced reimbursement for certain services to the worker(s) who provide those services.

    Provider-owned or -controlled housing

    PCA and CFSS provider agencies must ensure they are not the provider agency and housing provider for the same person.

    Other requirements

    PCA and CFSS providers must meet all requirements for MHCP providers. For more information, refer to MHCP Provider Manual – Provider basics.

    PCA/CFSS providers also must comply with all other applicable laws (e.g., labor laws, OSHA).

    Lead agencies cannot provide PCA/CFSS provider agency services.

    PCA/CFSS provider agencies may offer contracted case management services, but they cannot provide these services to people using them as a PCA/CFSS provider agency.

    CFSS only

    CFSS provider agencies must comply with CFSS cost reporting requirements, as explained on DHS – CFSS cost reporting.

    CFSS provider agencies may offer CFSS consultation services and CFSS financial management (FMS) services, but they cannot provide these services to people using them as a CFSS provider agency.
