Lead agency process to close, relocate or downsize an ICF/DD

Overview

Before a host county or county of financial responsibility (CFR) submits an Application for Changes to an ICF/DD, DHS-4677H (PDF) to DHS, it must complete the activities described on this page.

  • Host county activities

    When the host county wants to propose a closure, downsizing or relocation of an ICF/DD, the host county must:

    1. Contact each county of financial responsibility (CFR) to:

  • · Discuss the initial action plan
  • · Alert each CFR to consider its ability to accommodate each person’s move onto a waiver.
  • 2. Ensure the proposal aligns with the host county’s current local system needs plan (LSNP) and ICF/DD current and future capacity needs.

    3. Send a letter to all involved people who receive services, their families (and/or legal guardians) and case managers that includes information about:

  • · Proposed change to the ICF/DD
  • · Availability of alternative services within county
    (Note: People should contact their case manager if they have questions about their plan for alternative services.)
  • · What vacancies currently exist in alternative services.
  • 4. Coordinate alternative services with the CFR case manager for people affected by the change.

    5. Hold an informational meeting with each person and their family and/or legal guardian to answer their questions and concerns.

    6. Coordinate a request for proposals (if needed) to develop new services in the host county.

    7. Determine a timeline for the development of new services.

    8. Coordinate waiver service development in the host county, as needed.

    9. Ask its county moratorium liaison to submit Request to Close or Develop New Corporate Foster Care and Community Residential Settings, DHS-6021 if there is a recommendation for new corporate foster care development(s).

    10. Discuss proposed changes with the ICF/DD and document if the ICF/DD agrees with the plan on Application for Changes to an ICF/DD, DHS-4677H (PDF).

    11. Submit Application for Changes to an ICF/DD, DHS-4677H (PDF) by fax to the number listed on the form.

    12. Complete Local System Needs Plan Amendment, DHS-4677C (PDF) and submit it using the submit button on the form.

    After DHS makes a decision to approve or deny the proposal, the host county must:

    1. Notify people who receive services, their families (and/or legal guardians) and both host county and CFR case managers of DHS’ approval or denial of the plan (and timeframes, if approved).

    2. Coordinate planning activity with the DHS Licensing Division (651-296-3971) and Minnesota Department of Health (651-201-4121) if approved.

    CFR case manager activities

    When the CFR receives notification from the host county of a closure, downsizing or relocation proposal, the CFR must:

    1. Determine the living arrangement preferred by each person and their family (and/or legal guardian) by:

  • · Offering the person an informed choice of programs (e.g., ICF/DD, Developmental Disabilities [DD] Waiver services)
  • · Determining the person’s preference for where they want to live (e.g., city, rural, suburb, etc.)
  • · Offering the person a choice of vendors for their chosen program
  • · Determining the person’s preferred roommate/housemates, if desired
  • · Determining the person’s preferred type of housing (e.g., apartment building, single-family home, townhome).
  • 2. Notify the DHS Public Guardianship Office if the person is subject to public guardianship.

    3. Coordinate the following services:

  • · Complete person-centered planning and determine each person’s preferences for services
  • · Identify vacancies in other ICFs/DD
  • · Coordinate a person’s move to an alternate ICF/DD if they choose that option
  • · Initiate the host county notification with the Notification of Residential Placement, DHS-7418 (PDF) when necessary
  • · Request a MnCHOICES assessment for each person who is moving
  • · Create or update each person’s support plan
  • · Convene intake and/or discharge meetings for each person who is moving
  • · Prepare for the transfer of each person’s property, assets and appropriate records.
