Purpose: To provide information and guidance on changes to out-of-home respite services for people on AC, BI, CAC, CADI, DD and EW

Changes to out-of-home respite services

DHS recently made changes to out-of-home respite services for people on the following programs:

  • · Alternative Care (AC)
  • · Brain Injury (BI) Waiver
  • · Community Access for Disability Inclusion (CADI) Waiver
  • · Community Alternative Care (CAC) Waiver
  • · Developmental Disabilities (DD) Waiver
  • · Elderly Waiver (EW).
  • These changes:

  • · Clarify the 245D service license requirements, unless the provider meets one of the exclusions listed on CBSM – Exclusions from Chapter 245D licensure
  • · Clarify that if the person is younger than age 18, the setting must be licensed unless the provider is a related individual
  • · Limit the number of people age 18 or older receiving respite in unlicensed settings to a maximum of six people, with the exception of camps (applies to people on BI, CAC, CADI and DD waivers only)
  • · Allow people to receive respite in an intermediate care facility for persons with developmental disabilities (ICF/DD) (applies to people on the DD Waiver only).
  • We updated CBSM – Respite to include these changes.

    Instructions to implement changes

    Lead agencies must update people’s service plans to reflect these policy changes at their annual reassessments (or sooner, if desired).

    To help lead agencies determine if an unlicensed setting will meet the person’s assessed needs, DHS created HCBS Safety Checklist for Out-of-Home Respite Services in an Unlicensed Setting, DHS-7759E (PDF). If a person is on BI, CAC, CADI or DD, this form is required. If a person is on AC or EW, this form is an optional resource.
