Purpose: To announce the implementation of integrated community supports (ICS) for the Community Alternative Care (CAC) and Developmental Disabilities (DD) waivers

ICS available on CAC and DD waivers
Effective Jan. 1, 2023, ICS is available to people on CAC and DD waivers. DHS received federal approval from the Centers for Medicare & Medicaid Services (CMS) to add ICS to the CAC and DD waivers through the annual DD Waiver plan renewal and the CAC Waiver plan amendments (refer to the Dec. 28, 2022, eList and July 13, 2022, eList).
This approval does not include any proposed changes from the CAC Waiver plan renewal or the Brain Injury (BI) and Community Access for Disability Inclusion (CADI) waiver plan amendments (refer to the Nov. 14, 2022, eList about the CAC Waiver and Nov. 14, 2022, eList about the BI and CADI waivers).
This approval does not affect people on BI and CADI waivers because ICS is already available through these waivers.
Implementation instructions
Lead agency staff can authorize ICS for people in approved and enrolled settings effective Jan. 1, 2023. For a list of approved and enrolled ICS settings, refer to CBSM – Resource: ICS settings.
DHS will begin a rolling implementation of ICS to support an orderly transition for people on CAC and DD waivers. The following sections provide more detail about implementation timelines.
Moving into an ICS setting on or after Jan. 1, 2023
The lead agency will authorize ICS upon move in for people on CAC and DD waivers who move into an ICS setting to receive ICS on or after Jan. 1, 2023.
Living in an approved and enrolled ICS setting before Jan. 1, 2023, and following the ICS transition plan guidance
The lead agency will authorize ICS on a rolling basis, beginning March 1, 2023, for people on CAC and DD waivers who live in an ICS setting that is:
This means each person on CAC or DD who lives in the ICS setting will continue to receive their current services until one of the following occurs:
People who have renewals in January or February 2023 may choose to transition to ICS on or after Jan. 1, 2023, or wait until their next renewal in 2024. The lead agency must update the person’s support plan to reflect that the person made an informed choice.
The lead agency cannot authorize ICS for a person living in an ICS setting that is not enrolled with MHCP.
Living in a supported apartment setting not approved or enrolled as an ICS setting by March 1, 2023
There is not an additional transition allowance for provider-controlled settings not approved by DSD by March 1, 2023.
Home and community-based services (HCBS) providers that operate supported apartment programs that have not transitioned to ICS settings must do one of the following:
The lead agency cannot authorize ICS or own-home services delivered by a provider that has direct or indirect financial interest in a person’s housing if the location is not an approved and enrolled ICS setting as of March 1, 2023.
