Public comment period for amendments to the disability waiver plans

DHS seeks public comments on Summer 2018 federal waiver plan amendments (PDF) before it submits the amendments to the Centers for Medicare & Medicaid Services (CMS) for approval. These amendments apply to the following home and community-based services (HCBS) waivers:

  • · Brain Injury (BI)
  • · Community Alternative Care (CAC)
  • · Community Access for Disability Inclusion (CADI)
  • · Developmental Disabilities (DD).

    What these amendments do

    These amendments to the BI, CAC, CADI and DD waiver plans seek federal approval to:

    1. Add an exception to the consumer directed community supports (CDCS) budget methodology to provide a 5 percent budget enhancement for increased wages/benefits for workers if the:

  • · CDCS participant is eligible for 12 or more hours of PCA per day
  • · Worker has completed qualifying training (For more information, see training requirement section on the DHS — Enhanced rates and training stipends for support workers page.)
  • 2. Increase the rate paid for extended PCA for participants eligible for 12 or more hours of PCA per day
    3. Update the rate stabilization schedule per 2017 legislative requirements by adding an additional banding year with a 1 percent adjustment in 2020
    4. Revise language to be consistent across waivers
    5. Remove outdated language.

    Additional banding year

    The implementation of the Disability Waiver Rate System (DWRS) included a banding period in which the amount rates could change were limited for people and providers who had services in 2013. The initial banding period went through Dec. 31, 2018. The 2015 legislature later approved a sixth year of banding through Dec. 31, 2019. This sixth year of banding subsequently was approved by CMS in previous waiver amendments.

    During the 2017 legislative session, the Minnesota Legislature approved a seventh year of banding (through calendar year 2020) depending on federal approval. This 2018 summer amendment seeks federal approval to implement the seventh year.

    The proposed seventh year of banding will limit the amount that banded DWRS rates can change by 1 percent from the rate that was authorized the year before.
