EIDBI background study requirement updates

DHS updated the EIDBI background study process to align with new legislative requirements in Laws of Minnesota 2025, 1st Spec. Sess., chapter 9, article 6.

Effective Aug. 5, 2025, EIDBI agencies and providers must have a completed DHS background study through NETStudy 2.0 with an eligible or set-aside result before they provide services.

Applicability

The EIDBI background study process applies to people in the following roles:

  • · EIDBI agency owners with at least a 5% ownership stake.
  • · EIDBI agency operators, which includes board members and people who oversee billing, management or policies.
  • · Employees or volunteers that provide direct contact EIDBI services.
  • Previously, people in these roles could provide services under certain conditions when DHS needed more time to determine their eligibility.

    Provider agency actions

    Provider agencies should make sure all owners, operators, employees and volunteers complete a DHS background study through NETStudy 2.0 and receive an eligible or set-aside result.

    If everyone in the roles listed above has an eligible or set-aside result from a DHS background study through NETStudy 2.0, the provider agency is compliant.

    If anyone in the roles listed above does not have an eligible or set-aside result from a DHS background study through NETStudy 2.0, the provider agency must initiate a background study for them in NETStudy 2.0.

    Background study completion tips

    After a provider agency initiates a background study through NETStudy 2.0, they should tell the study subject to complete their consent and disclosure and their fingerprinting before the given deadline. If they do not meet the deadline, NETStudy 2.0 will close the study, and the agency must submit a new study.

    Provider agencies can monitor consent and disclosure and fingerprinting completion in NETStudy 2.0.
