STAY OF DEPORTATION / ORDERS OF SUPERVISION

A person has a final removal order but they are not actively being deported. The person is monitored by an Immigration and Customs Enforcement (ICE) officer and must check in with that officer regularly. They must follow rules on what is called an “Order of Supervision”. Some people are granted an Employment Authorization Document which is evidence that they are following their officer’s requirements.
This status is not related to Withholding of Removal or Deportation Withheld. See 0031.12 (Withholding of Removal/Deportation Withheld). Eligibility is very different for these statuses, carefully note which status the client has.
