IMPROPER ASSET TRANSFERS

MFIP, GA:
Consider any transfer of assets improper if it is done to establish or maintain eligibility for assistance as defined below. See 0015.69.09 (Improper Transfer Ineligibility) for how to compute periods of ineligibility due to improper transfers.
Consider an asset transfer improper if it meets ALL the following conditions:
● | The transferred asset is a counted asset. |
● | The transfer occurred less than 12 months before the date of application, while the application is pending, or while the unit is eligible for MFIP. |
● | The equity value of the transferred asset is over the asset limit. |
● | The unit did not receive compensation equal to or over the equity value of the asset minus any costs of the transfer. |
If there are multiple transfers within a month, combine the value of the transfers to determine if there has been an improper transfer.
SNAP:
Only non-categorically eligible SNAP units ARE subject to an asset test. Categorically eligible SNAP units are NOT subject to an asset test. See 0013.06 (SNAP Categorically Eligibility/Ineligibility) to determine categorical eligibility or ineligibility.
For non-categorically eligible SNAP units, see 0015.81 (Assets – SNAP) for the SNAP asset policies, including transferred assets.
MSA:
For non-SSI recipients, follow GA.
For SSI recipients, no action is required. SSA makes all asset determinations.
HSP:
Follow MSA for aged, blind, or disabled clients. Follow GA for all other adults.
