Waiver amendments approved by CMS
The federal Centers for Medicare & Medicaid Services (CMS) approved DHS’ waiver amendment package on April 19, 2023. The amendment package affects the Developmental Disabilities (DD) Waiver.
CMS has not approved the Community Alternative Care (CAC) Waiver renewal yet. We will send an eList announcement once we receive approval for the CAC Waiver.
Implementation of changes and clarifications
DHS has not implemented the changes and clarifications in this eList yet. First, we must update our policy manuals and MMIS. We will send eList announcements and/or update CBSM – What’s new when we implement the changes and clarifications.

The commissioner may also authorize services provided in settings that have received authority under Minnesota Statutes, section 245A.11, subd. 2a, paragraph (f) for a fifth bed [add] or settings that have received a variance to allow for the use of a sixth bed under Minnesota Statutes, section 245A.11, subd. 2a, paragraph (d) [end add]. When more than one living setting is located on the same or adjoining property and the settings or property is owned or leased by a single provider, services may only be covered for participants living in one of the settings.
