Changes to lead agency approval of waiver/AC service vendors

In this announcement, DHS shares four important messages:

  • · Reminder of which home and community-based waiver and Alternative Care (AC) services the lead agency can approve a vendor not enrolled with MHCP to deliver
  • · New requirements for how lead agencies approve vendors to deliver these services
  • · New training on the vendor approval process
  • · When the HCBS lead agency review team will begin to enforce vendor approval requirements.
  • Services the lead agency can approve a vendor not enrolled with MHCP to deliver

    Lead agencies have been and will continue to be able to approve vendors not enrolled with MHCP to deliver certain home and community-based services available under the AC program and BI, CAC, CADI, DD and EW waivers.

    This group of services was called Tier 2 and Tier 3 services. They now, as a whole, are called approval-option services. Tier 2 services now are called direct-delivery services. Tier 3 services now are called purchased-item services. This name change is effective immediately.

    Approval-option: direct-delivery services (formerly Tier 2)

    Approval-option: direct-delivery services include:

  • · AC discretionary services – one-on-one
  • · Chore services
  • · Environmental accessibility adaptations (EAA) / home modification / installation
  • · Family caregiver training and education (AC, EW) – one-on-one
  • · Family training and counseling / training (BI, CAC, CADI, DD) – one-on-one, in-home
  • · Homemaker / cleaning
  • · Transitional services / EW-related supports
  • · Transportation / non-commercial, individual driver.
  • Approval-option: purchased-item services (formerly Tier 3)

    Approval-option: purchased-item services include:

  • · 24-hour emergency assistance / equipment (PERS)
  • · AC discretionary services – other than one-on-one
  • · Assistive technology / equipment
  • · EAA / home and vehicle modifications / expenses
  • · Family caregiver training and education (AC, EW) – group setting
  • · Family training and counseling / training (BI, CAC, CADI, DD) – group setting
  • · Specialized equipment and supplies (including PERS)
  • · Transitional services / items and expenses
  • · Transportation / commercial, common carrier (e.g., bus, taxi, etc.).
  • New requirements

    If the lead agency chooses to approve vendors to deliver approval-option services, it now:

  • · Must complete an entry on the Minnesota HCBS Waiver/AC Approval-Option Service Vendor Tracking Log, DHS-7004A for every vendor it approves to deliver services.
  • · Must obtain a signed Minnesota HCBS Waiver/AC Approval-Option Service Vendor Assurance Statement, DHS-7004B from every direct-delivery service vendor.
  • · Must assure every vendor it approves to deliver “direct-contact” approval-option services completes a DHS background study.

    Training

    HCBS lead agency review team enforcement

    Beginning Feb. 1, 2017, the HCBS lead agency review team will issue a corrective action plan to a lead agency when the team observes a pattern of non-compliance with vendor review and approval requirements.

    Since 2014, the lead agency review team has reviewed how lead agencies approve vendors. Their review has been educational. It focused on lead agencies’ compliance with federally approved waiver/AC service standards and DHS approval process requirements. The lead agency review team’s findings guided DHS’ recent policy refinements.
