Purpose: To announce policy refinements and enforcement changes to lead agency approval of waiver/AC approval-option (formerly Tier 2 and Tier 3) service vendors

Changes to lead agency approval of waiver/AC service vendors
In this announcement, DHS shares four important messages:
Services the lead agency can approve a vendor not enrolled with MHCP to deliver | Lead agencies have been and will continue to be able to approve vendors not enrolled with MHCP to deliver certain home and community-based services available under the AC program and BI, CAC, CADI, DD and EW waivers. This group of services was called Tier 2 and Tier 3 services. They now, as a whole, are called approval-option services. Tier 2 services now are called direct-delivery services. Tier 3 services now are called purchased-item services. This name change is effective immediately. HCBS lead agency review team enforcement | Beginning Feb. 1, 2017, the HCBS lead agency review team will issue a corrective action plan to a lead agency when the team observes a pattern of non-compliance with vendor review and approval requirements. Since 2014, the lead agency review team has reviewed how lead agencies approve vendors. Their review has been educational. It focused on lead agencies’ compliance with federally approved waiver/AC service standards and DHS approval process requirements. The lead agency review team’s findings guided DHS’ recent policy refinements. |
