GENERAL WORK RULES FOR SNAP

SNAP:
Certain SNAP recipients must follow work rules to get SNAP benefits. There are 2 sets of work rules; general work rules and time-limited work rules. See 0011.24 (Able-Bodied Adults Without Dependents) for time-limited rules. SNAP recipients who meet the criteria below must follow general work rules.
● | People ages 16-59 who do not meet a work registration exemption under 0028.06.12 (Who Is Exempt From SNAP Work Registration). |
● | People who are residing in a unit with a unit member under the age of 18, even if the unit member is not eligible for SNAP. Uncle Harry Food Support units that are residing in a home with a unit member under the age of 18 meet this exemption even if the person under the age of 18 is in an MFIP or RCA unit. |
● | Participants of Refugee Cash Assistance (RCA) when they are NOT working with a Refugee Employment Services Provider. If there is no Refugee Employment Services provider available, then the participant must be referred to a SNAP E&T provider. See 0030.12 (Refugee Employment Services). |
● | People who have a verified pregnancy. For MAXIS coding instructions when the pregnancy is and is not verified, see TEMP Manual TE02.05.70.02 (SNAP STAT/WREG Coding - Pregnant Women). |
SNAP applicants and recipients who meet the criteria above must follow the general work rules listed below. These rules must be followed, beginning with the 60-day period prior to their SNAP application and anytime while receiving SNAP.
● | If working at least 30 hours a week, they cannot quit or reduce work hours below 30 hours a week without good cause. For information about good cause reasons, see 0028.21 (Good Cause Non-Compliance - SNAP/MSA/GA/GRH). |
● | They must accept a job offer, unless it is not suitable for them. For information about unsuitable and suitable work see 0028.18.03 (Suitable/Unsuitable Work). |
When you learn a recipient did not meet a general work requirement you must follow these steps:
1. | Screen the recipient for exemptions 0028.06.12 (Who Is Exempt From SNAP Work Registration). If an exemption is met, the person is no longer subject to the general work rules. Update the case appropriately and case note the exemption they meet and if verifications have been requested. |
2. | If an exemption is not met, screen the recipient for good cause as outlined in 0028.21 (Good Cause Non-Compliance - SNAP/MSA/GA/GRH). You must ask the participant about the situation. Do not ask the employer. Grant good cause when the client’s explanation appears reasonable. Document in case notes the conversation with the client and the good cause determination. |
3. | If good cause is not granted, the SNAP applicant or recipient is not eligible for SNAP and must serve a sanction. To impose general work rules sanctions, see 0028.30.06 (Sanctions for Not Meeting SNAP Work Rules). |
