SANCTIONS FOR NOT MEETING SNAP WORK RULES

SNAP:
Certain SNAP recipients must follow work rules to get SNAP benefits as outlined in 0028.07 (General Work Rules for SNAP). When a SNAP applicant or recipient subject to the general work rules does not meet them, they must have good reason or be sanctioned from receiving SNAP. Review the situation to make sure the client is not exempt from SNAP general work rules and determine if the client has good reason for not meeting one of the work rules prior to implementing a sanction. See 0028.21 (Good Cause Non-Compliance - SNAP/MSA/GA/GRH) for more information on granting good cause.

If the recipient is not exempt from the general work rules and good cause cannot be granted, follow the sanction guidelines below.

Review the case to determine who the Principal Wage Earner (PWE) is. Actions taken on the case will be different if the person to be sanctioned is the PWE. See 0028.03.06 (Determining SNAP Principal Wage Earner) for more information.

If the person to be sanctioned is the PWE, the entire case is sanctioned and closed. If the PWE joins another household as its PWE, that unit will be sanctioned and unable to receive SNAP for the remainder of the PWE’s sanction period as listed below.

If the person to be sanctioned is not the PWE, only that person is ineligible for SNAP. A non-PWE who is no longer eligible may still have income that needs to be counted for the unit. See 0016.03 (Income from Disqualified Unit Members).


SANCTION OCCURRENCE AND LENGTH

The number of times the person has been sanctioned in the past determines what occurrence the current sanction is. If the SNAP recipient served either a SNAP Employment & Training (SNAP E&T) or a general work rules sanction in the past, those occurrences are added together.

The 1st sanction occurrence is loss of SNAP for 1 month.

The 2nd sanction occurrence is loss of SNAP for 3 months.

The 3rd and all subsequent SNAP work rule sanction occurrences is loss of SNAP for 6 months.


The sanction must begin the 1st of the next available month following 10-day notice requirements. For system instructions see TEMP Manual TE02.10.66 (Voluntary Quit Sanctions).

Once the sanction period is over, a new application is required or the unit must request to add the person back to the SNAP unit. See 0008.06.07 (Adding a Person to the Unit- SNAP) for more information.

REESTABLISHING ELIGIBILITY

When an entire case is closed due to the sanctioned member being the PWE, the unit may reestablish eligibility if:

The PWE leaves the household.

A new and eligible person joins the household as the PWE.

 

OR

The PWE becomes exempt from work requirements as listed in 0028.06.12 (Who Is Exempt From SNAP Work Registration) during the sanction period.


If the sanctioned member is NOT the PWE, they may reestablish eligibility if the sanctioned person becomes exempt from work requirements as listed in 0028.06.12 (Who Is Exempt From SNAP Work Registration) during the sanction period.

If the sanction unit or person reestablishes eligibility under 1 of the options above, prior to the end of the closure month, the sanction can be lifted. This would not be considered a sanction occurrence and would not be counted for any future sanction occurrences. Update the case and remove the sanction. Explain in case notes how the person reestablished eligibility.imageimageimage
