Specialized equipment and supplies

Legal authority

Federally approved Brain Injury (BI), Community Alternative Care (CAC), Community Access for Disability Inclusion (CADI) and Elderly Waiver (EW) plans, Minn. Stat. §256B.0913 (Alternative Care [AC] program), Minn. R. 9505.0310, Minn. Stat. §256B.0922 (Essential Community Supports [ECS] program)

Definition

Specialized equipment and supplies: Devices (including assistive technology), controls, medical appliances or supplies specified in the person’s support plan.

Eligibility

A person is eligible to receive specialized equipment and supplies if the item allows the person to do one of the following:

  • · Communicate with others.
  • · Perceive, control or interact with their environment.
  • · Perform activities of daily living (ADLs).
  • Covered services

    Specialized equipment and supplies includes:

  • · Durable and non-durable medical equipment and supplies denied under the Medical Assistance (MA) state plan.
  • · Add-ons to otherwise-approved MA state plan items determined necessary to meet the needs identified in the person’s support plan.
  • · Items that exceed the covered service limits under the MA state plan.
  • · Electronic tablets, both as part of a system of environmental controls and as an augmentative communication device (refer to electronic tablet section).
  • · Assistive technology (for assistive technology under the Developmental Disabilities [DD] Waiver, refer to CBSM – Assistive technology).
  • · Standalone equipment (e.g., shower chair, portable/travel ramp for use in the community) that is not part of a home or vehicle modification project through CBSM – Environmental accessibility adaptations.
  • · Enteral nutritional products (refer to CBSM – Waiver oral and enteral nutritional products).
  • · Equipment repair and maintenance, unless covered by the manufacturer's warranty.
  • · Items necessary for life support and supplies necessary for the proper functioning of such life support items.
  • · Pre-moistened cleansing wipes to aid in disability-related continence care.
  • · Thickening agents when it is determined the person has a medical need.
  • · Used equipment when all criteria are met.
  • Note: The purchase price includes necessary training or instruction on the use of specialized equipment and supplies.

    Additional covered services for AC and EW

    In addition to the above covered services, specialized equipment and supplies through AC and EW also includes:

  • · Personal emergency response systems (PERS) (refer to CBSM – PERS).
    Note: For BI, CAC, CADI and DD waivers, this service is covered under CBSM – 24-hour emergency assistance.
  • · Equipment and supplies in lieu of approved state plan items determined necessary to meet the medical or remedial needs identified in the person’s support plan.
  • · Equipment rental in a trial period.
  • · Evaluation of the need for the equipment and/or device.
  • · Oral nutritional products (refer to CBSM – Waiver oral and enteral nutritional products).
  • ECS

    Under ECS, specialized equipment and supplies is limited to PERS (refer to CBSM – PERS).

    Non-covered services

    Specialized equipment and supplies does not cover:

  • · Experimental treatments.
  • · Items covered under third-party payer liability (refer to MHCP Provider Manual – Medicare and other insurance).
  • · Items that do not provide direct medical or remedial benefit to the person.
  • · Oral nutritional products and electrolyte products (BI, CAC and CADI only).
  • · Foods (including organic or special diet needs), organ extracts and over-the-counter food supplemental products.
  • · Prescription and over-the-counter medications, compounds, solutions and related fees (including premiums and co-payments).
  • · Items sold as used equipment to a second member of the same family (refer to used equipment section).
  • · Utilities that operate the equipment or supply.
  • In addition, an item is not covered if it restricts a person’s rights or restrains them, and either:

  • · The item is not an adaptive aid or equipment, orthotic device or other medical equipment ordered by a licensed health professional to treat a diagnosed medical condition.
  • · The item violates the provisions of Minn. R. 9544.
  • Electronic tablet

    An electronic tablet is funded through the MA state plan as durable medical equipment if the person uses it only for purposes of augmentative communication.

    An electronic tablet is funded through the waiver/AC program under specialized equipment and supplies if the person uses the device to do one or more of the following:

  • · Perceive, control or interact with their environment.
  • · Perform ADLs.
  • · Augmentative communication and to perceive, control or interact with their environment or perform ADLs.
  • Used equipment

    The lead agency may authorize funding for used equipment when the equipment has been evaluated by one of the following professionals:

  • · Provider of specialized equipment and supplies.
  • · Occupational therapist who specializes in selling, installing or assessing equipment.
  • · Physical therapist who specializes in selling, installing or assessing equipment.
  • The professional evaluating the equipment must ensure:

  • · The used equipment meets the assessed needs of the person.
  • · The used equipment has been determined to be in good, working order.
  • · Fair market value is established for the equipment.
  • · The used equipment is cost-effective compared to purchasing new equipment.
  • The waiver will not fund used equipment when sold to a second member of the same family. For the purposes of this policy, family is defined as parents, siblings and children — any of whom are related by birth, marriage or adoption.

    Service amount

    BI, CAC and CADI

    For waivers that begin or renew before Jan. 1, 2024, the person may receive up to $3,909 of specialized equipment and supplies per waiver year.

    For waivers that begin or renew on or after Jan. 1, 2024, the person may receive up to $10,000 of specialized equipment and supplies per waiver year.

    For this purpose, a waiver year is calculated based on a 365-day period, which is determined by counting back from the service agreement header end-date. It may include previous service agreements if the 365-day period crosses previous service agreements. Once the service limit has been reached, additional spending must wait until the next waiver year. There are no exceptions to this limitation.

    AC and EW

    The person may receive specialized equipment and supplies up to the case mix budget cap, as authorized in the person’s support plan.

    Secondary information

    The lead agency should work with the provider to include a clear description of the item in the claim that matches the description of the item in the service agreement.

    Assistive technology devices or equipment

    For AC, BI, CAC, CADI and EW, assistive technology is available through specialized equipment and supplies.

    For DD, assistive technology is available through CBSM – Assistive technology.

    Provider standards and qualifications

    The following providers may enroll with Minnesota Health Care Programs (MHCP) to provide specialized equipment and supplies:

  • · Lead agency as an approval-option: purchased-item service when the case manager ensures services provide a cost-effective, appropriate means of meeting the needs identified in the person’s support plan (refer to the approval-option section of CBSM – Waiver/AC service provider overview).
  • · State plan medical equipment provider, as defined under Minn. R. 9505.0195.
  • · Pharmacy licensed by the Minnesota Board of Pharmacy, in accordance with Minn. R. 6800.0100 to 6800.9954.
  • · Medicare-certified home health agency, as defined under Minn. R. 9505.0195.
  • Authorization, rates and billing

    The lead agency authorizes specialized equipment and supplies at the market rate. For more information, refer to CBSM – Market rate services and Long-Term Services and Supports Service Rate Limits, DHS-3945 (PDF).

    PERS

    For AC and EW, PERS is available under the specialized equipment and supplies service. PERS has different service limits and authorization codes. For more information, refer to the PERS-specific entries on Long-Term Services and Supports Service Rate Limits, DHS-3945 (PDF) and CBSM – PERS.

    For BI, CAC, CADI and DD, PERS is available under CBSM – 24-hour emergency assistance.
