Definition | Night supervision services: Overnight assistance and supervision provided by a staff in the person’s own home when the person has an assessed need in one of the covered services areas. Eligibility | A person is eligible to receive night supervision services if they: 1. Live in their own home. 2. Are assessed to need overnight assistance and supervision in at least one of the following areas: | ||
Covered services | Night supervision services include an asleep or awake staff in the person’s own home performing an activity listed in the eligibility section. | ||
Non-covered services | Not covered within the serviceNight supervision cannot be used: 1. To prevent an outcome that has not previously occurred (i.e., as preventative safety). 2. Based on an assumption the person might need the service without an assessed need for it (i.e., as an assumptive safety service). 3. When the person does not have an assessed need for overnight supports for an activity listed in the eligibility section. 4. To support a person who either: 5. To pay for time the person’s caregiver (e.g., parent, legally responsible individual, staff) is asleep if the caregiver lives in the home. Services that cannot be authorized with night supervisionThe lead agency cannot authorize night supervision services when the services duplicate other Minnesota state plan or waiver services the person already receives. | ||
Limitations | A person cannot receive night supervision services for more than 12 hours in a 24-hour period. | ||

Provider standards and qualifications | Night supervision is a DHS enrollment-required service. For more information, refer to CBSM – Waiver/AC service provider overview. License requirementsUnless excluded, providers must meet one of the following requirements: 245D exclusionIn some cases, a person who receives night supervision can use an individual provider who meets requirements for exclusion from 245D licensure. For more information, refer to CBSM – Exclusions from 245D licensure. Background studyTo provide night supervision, providers must have a background study. For more information, refer to CBSM – Waiver/AC service provider overview – Required DHS background studies for direct-contact services. ReportingProviders licensed under 245D must report all uses of controlled procedures, emergency use of manual restraint and prohibited procedures according to Minn. Stat. §245D.06, subd. 5 to DHS via the Behavioral Intervention Report Form, DHS-5148. | ||
