AASD and DSD eList announcement

Purpose: To announce the federal COVID-19 public health emergency (PHE) extension and end date that affects COVID-19 waivers for aging and disability services

On Jan. 11, 2023, the federal government extended the COVID-19 public health emergency for an additional 90 days, until April 11, 2023. On Jan. 30, it announced it plans to end the emergency on May 11, 2023.

The end of the public health emergency will begin the wind down of several waivers and modifications to Minnesota Department of Human Services programs and services. DHS is carefully planning for the end of the public health emergency and how it will affect people served by long-term services and supports.

The Aging and Adult Services and Disability Services divisions will continue to keep lead agencies apprised of upcoming changes and provide direction for the wind down of affected COVID-19 waivers at the end of March.

Waivers that expire at the end of the public health emergency

  • · Allowing parents of minors and spouses to provider personal care assistance (PCA) services. See the AASD and DSD eList: COVID-19 modification to allow parents of minors and spouses to provide PCA services for information about this waiver. Parents of minors and spouses who have been providing PCA services during the COVID-19 emergency should work with their PCA agency or their county, tribal government or managed care organization to develop an alternative plan for provision of services.
  • · CV.24: Allowing phone and video visits in place of in-person contact for child welfare, mental health and vulnerable adult/developmental disabilities targeted case management services. (see Bulletin #21-69-04 (Corrected): DHS extends temporary changes to Targeted Case Management face-to-face contact requirements).
  • Waivers that remain in effect temporarily

    The following COVID-19 waivers will remain in effect for up to six months after the end of the public health emergency:

  • · CV.15: Allowing long-term services and supports (LTSS) assessments and reassessments to be conducted remotely (see March 23, 2020, eList for more information).
  • · CV.15: Allowing case management visits to be conducted remotely (see April 6, 2020, eList).
  • · CV.44: Allowing adult day services to be provided remotely (see the Adult day services provided during COVID-19 emergency FAQ and the Information about COVID-19 from Licensing webpage).
  • The following COVID-19 waiver remains in effect until further notice from DHS:

  • · CV.17: Preventing termination of eligibility in LTSS programs (see May 16, 2022, eList and Frequently asked questions about maintaining HCBS eligibility under COVID-19 requirements webpage). DHS will communicate more about this change and the transition timeline.
  • Moving Home Minnesota

    Moving Home Minnesota (MHM) also allows waivers to the grant requirements (see May 20, 2020, eList). These waivers include:

  • · Allowing verbal approval and consent when written signatures might not be obtainable.
  • · Allowing phone or video communication when an MHM transition coordinator or case manager cannot meet face-to-face with the MHM participant.
  • · Ability to extend the 180-day transition coordination period using the Moving Home Minnesota Communication Form (DHS-6759H).
