Resources about temporary suspension and termination of 245D-licensed residential supports and services

DHS created this eList to ensure:

  • · Providers understand the process to notify DHS about service terminations and suspensions, including which services require notice and the correct fax number to use.
  • · Lead agency case managers are familiar with provider requirements.
  • Process for providers to notify DHS

    Residential service providers licensed under Minn. Stat. §245D.03 subd. 1(c)(3) must notify DHS when they issue a:

  • · Temporary suspension of services.
  • · Termination of services.
  • Providers must fax notices to 651-431-7406. DHS monitors these faxes and follows up with lead agency case managers to provide technical assistance.

    Note: This requirement does not apply to providers who deliver any other basic or intensive service (i.e., not licensed under Minn. Stat. §245D.03 subd. 1(c)(3)). Other basic and intensive services have specific processes that outline provider responsibilities when issuing a service suspension or termination.

    Providers must follow requirements for temporary service suspension and service termination in Minn. Stat. §245D.10 and their own temporary service suspension and termination policies. If you are unsure of your responsibilities as a licensed provider, review 245D requirements, resources on DHS – Licensing and other licensure requirements (e.g., Department of Health licensure requirements).     Resources for lead agencies

    DHS updated and expanded CBSM – Guide to support a person with a residential service termination notice from a 245D-licensed provider. This toolkit now includes specific pages that describe:

  • · Overview of the process for residential service termination.
  • · Case manager responsibilities and legal rights of the person or their legal representative.
  • · Waiver service options to consider as additional supports.
  • · Non-waiver service options to consider as additional supports.
  • · Mental health service options to consider as additional supports.
  • DHS encourages lead agencies to review these resources carefully to determine which options might benefit the person.
