Reminder about lead agency responsibilities for out-of-home crisis respite in an MDH-licensed hotel

DHS encourages lead agencies to review CBSM – Crisis respite about their responsibility to notify DHS about out-of-home crisis respite daily in an MDH-licensed hotel. This eList provides an overview of the requirements.

Lead agency responsibilities to notify DHS

Lead agencies may only authorize crisis respite in an MDH-licensed hotel for children or adults for up to seven days in the following situations:

  • · A licensed foster care facility/community residential setting (CRS) that provides out-of-home crisis respite is not immediately available within 50 miles of the person’s home.
  • · Available openings are not appropriate for the person’s needs.
  • After seven days of crisis respite in an MDH-licensed hotel, the lead agency must submit documentation of continued need for crisis respite in an MDH-licensed hotel to DHS for review and approval on a weekly basis. For instructions to submit documentation, refer to the settings section of CBSM – Crisis respite.

Note: Lead agencies must follow additional requirements to notify DHS when the person who receives services is a minor. For more information, refer to DHS Bulletin #24-68-05 – Clarifying when disability waiver community residential services are foster care placements for children and youth (PDF).

Lead agency responsibilities for providers requirements and service delivery

    Lead agencies are responsible to:

  • · Ensure crisis respite providers meet requirements for licensing.
  • · Verify service deliverables.
  • A crisis respite provider must have a license under Minn. Stat. Ch. 245D as an intensive support service provider and meet requirements on CBSM – Crisis respite.
