Purpose: To announce a legislative change to allow CDCS and CSG workers to waive their right to paid time off (PTO) when they provide services to their family members

Legislative changes to PTO for CDCS and CSG workers

As of May 25, 2024, CDCS and CSG workers can waive their right to PTO under the collective bargaining agreement when they provide services to their family members who receive CDCS or CSG services. The earned sick and safe leave law defines “family member” in Minn. Stat. §181.9445, subd. 7.

CDCS and CSG workers were not able to waive PTO between Jan. 1, 2024, and May 25, 2024.

CDCS and CSG workers must follow FMS provider policies if they want to start waiving PTO. If a CDCS or CSG worker waives PTO, they may not accrue earned sick and safe time until the start of the next service plan year.

Authority for change

During the 2024 legislative session, the Minnesota Legislature amended the earned sick and safe time law. The change is located in Laws 2024, chapter 127, article 11, section 15.
