EIDBI legislative updates
The 2025 Minnesota Legislature passed changes that affect the EIDBI benefit in Laws of Minnesota 2025, 1st Spec. Sess., chapter 9, article 6. This eList provides a summary of the changes. DHS will share more information and resources in future eList announcements.
1. Provisional licensing requirements
The Legislature created new provisional licensing requirements that affect all EIDBI agencies enrolled to provide services. For more information, refer to DHS – EIDBI licensing.

Existing EIDBI agencies can continue to provide services, in accordance with Minn. Stat. §256B.0949, while they wait for additional instructions from DHS.

3. Investigation of alleged maltreatment
Effective July 1, 2025, DHS Licensing is the lead investigative agency for reports of alleged maltreatment in EIDBI.

To report alleged maltreatment of a person younger than age 18 in an EIDBI program, call DHS Licensing at 651-431-6600.
To report alleged maltreatment of a person age 18-21 in an EIDBI program, call the Minnesota Adult Abuse Reporting Center (MAARC) at 1-844-880-1574.

5. Employment status
Effective immediately, all Level I, II and III EIDBI providers must be EIDBI agency employees. These provider types can no longer be independent contractors.

6. Provider qualifications
Effective immediately, provider shortage exceptions (i.e., variances) are now official provider qualifications. Previously, DHS and the federal Centers for Medicare & Medicaid Services (CMS) approved those exceptions.
