Purpose: To announce EVV compliance requirements that DHS will enforce beginning Jan. 1, 2026

EVV compliance requirements

Beginning in 2026, DHS will review EVV compliance and enforce compliance requirements for all providers, including financial management services (FMS) and managed care organizations (MCOs). We will do this to make sure providers meet federal and state EVV requirements.

Compliance requirements timeline

January 2026

Effective Jan. 1, 2026, providers must:

  • · Complete HHAeXchange (HHAX) enrollment, regardless of system or payer.
  • · Use their EVV system to submit complete data for all visits, including noncompliant visits.
  • · Meet at least 50% compliance for all visits billed after this date.
  • DHS will:

  • · Review compliance data from October 2025 to December 2025.
  • · Contact providers below 50% compliance.
  • · Use this review to raise awareness and give providers time to prepare.
  • April 2026

    DHS will:

  • · Review compliance data from January 2026 to March 2026.
  • · Send formal corrective action notices to providers below 50% compliance.
  • · Conduct quarterly reviews and send corrective actions from this point forward.
  • July 2026

    Effective July 1, 2026, providers must:

  • · Use their EVV system to submit complete data for all visits, including noncompliant visits.
  • · Meet at least 80% compliance for all visits billed after this date.
  • DHS will:

  • · Review compliance data from April 2026 to June 2026.
  • · Send formal corrective action notices to providers below 50% compliance.
    Note: DHS will begin sending formal corrective action notices to providers below 80% compliance in October 2026.
  • October 2026

    DHS will:

  • · Review compliance data from July 2026 to September 2026.
  • · Send formal corrective action notices to providers below 80% compliance.
  • Provider responsibilities

    In addition to the provider actions above, providers are responsible to:

  • · Monitor their own compliance performance for all tax IDs and National Provider Index (NPI)/Unique Minnesota Provider Index (UMPI) numbers associated with their agency.
  • · Regularly review reports to identify and correct compliance issues.
  • · Make corrections before requiring DHS outreach or corrective actions.
  • · Monitor MN-ITs mailboxes for DHS communications about EVV compliance.
  • Compliance reports and corrective actions

    On the 25th of each month, DHS and providers receive the provider’s compliance report from the previous month. HHAX sends the compliance report to the email address the provider used to complete the HHAX enrollment form.

    DHS:

  • · Reviews the compliance report for each provider.
  • · Sends corrective action notices to MN-ITs mailboxes for providers who do not meet compliance thresholds.
  • Corrective action notices may require providers to:

  • · Increase compliance rates by a specified deadline.
  • · Send DHS a written plan describing how they will improve compliance.
  • · Meet with DHS to review compliance performance and next steps.
  • DHS may escalate enforcement (e.g., take back previously paid claims, stop payment) if a provider does not:

  • · Respond to corrective actions.
  • · Make the required improvements.

    DHS is committed to supporting providers as they prepare for and meet these requirements. We will share the following information in an eList announcement when it is available:

  • · Provider engagement sessions.
  • · HHAX training opportunities and engagement events.
  • · Resources to help providers monitor and improve compliance metrics.
