EVV compliance enforcement

As of Jan. 1, 2026, DHS began enforcing EVV compliance thresholds as outlined in CBSM – EVV compliance policy.

Beginning with EVV data from January through March 2026 (i.e., quarter 1, 2026), DHS will:

  • · Review and enforce EVV compliance on a quarterly basis.
  • · Act to enforce compliance (e.g., payment holds, enrollment termination) in accordance with policy if a provider does not meet EVV compliance requirements.
  • · Monitor all providers, including providers that report very high or 100% EVV compliance.
  • · Conduct additional review, audit or other compliance actions if we identify indicators that a provider did not submit all required EVV data.
  • Compliance status check for October through December 2025 (i.e., quarter 4, 2025)

    DHS is using data from October through December 2025 to help providers prepare for ongoing quarterly enforcement. For EVV compliance data from October through December 2025:

  • · Providers that did not meet the new EVV compliance threshold will receive a status check letter in their MN-ITs mailbox by mid-March 2026. The letter outlines their current compliance status and resources to support improvement.
  • · Providers that met the new EVV compliance threshold will not receive a status check letter at this time.
  • Note: Providers will receive a status check letter if any national provider identifier (NPI) or unique Minnesota provider identifier (UMPI) numbers that provide required EVV services associated with their tax ID are not enrolled in EVV, even if other NPI/UMPI numbers meet compliance requirements. To resolve this issue, providers must work with HHAeXchange (HHAX) by using the HHAX Client support portal.

    Reminders for providers

    Providers must:

  • · Report all EVV data, including manual entries and noncompliant data. Providers that only submit compliant visits do not meet EVV data submission requirements (refer to the data submission section of CBSM – EVV compliance policy).
  • · Review the monthly compliance report they receive from HHAX on the 25th of each month. The report includes the provider’s percentage of EVV compliant visits for the previous month and year-to-date compliance percentage.
    Note: Payers also must review the monthly compliance report.
  • · Only list NPI/UMPI numbers that provide required EVV services when they enroll with HHAX.
  • Providers do not need to notify DHS when they start using EVV.
