2026 legislative changes for OBRA Level II evaluative reports
The 2026 Legislature changed Minn. Stat. §256.975, subd. 7d(b) to remove the budget for OBRA Level II evaluative reports. Effective July 1, 2026, lead agencies can no longer bill DHS for OBRA Level II activity.
The Legislature did not change the requirements for completing OBRA Level II evaluative reports for people with developmental disabilities or mental illness. For information about these requirements, refer to CBSM – Preadmission screening and OBRA and CBSM – OBRA Level II evaluative report for people with developmental disabilities. The federal Centers for Medicare & Medicaid Services (CMS) requires these evaluations, per 42 C.F.R. 483, subp. C, 483.100 – 483.138.
